Florida RON vs mobile notary — online registration is live, the session file is ten years

This page is a notary scorecard. It is not a mailbox directory. Form 1583 appears because mailbox signup is a common reason a Florida founder needs a notary this week. The form is the use-case. The CMRA is someone else’s product.

This page is not legal advice. A Florida-commissioned notary may perform remote online notarization if that notary separately registered as an Online Notary Public with the Department of State. A traditional Florida notary without that registration still needs physical presence. A bank, a CMRA, or the Postal Service still decides whether this packet may be remote.

The Florida grade that is not a vendor letter

We grade the state rule first. A platform cannot turn a traditional Florida notary into an online notary. It also cannot erase the Online Notary Public registration that Florida has issued since January 1, 2020.

Two Florida filings, and why a webcam is not always enough

The Department of State is blunt: remote online notarization is not automatic with a traditional Florida commission.

• Online notarization is a remote act. The notary must hold the extra Online Notary Public registration, be physically inside Florida at the time of the act, and meet the person by two-way audio and video. The principal and any witnesses may be anywhere. If the principal is outside Florida, the notary must confirm — verbally or in writing — that the principal wants a Florida notarial act under Florida law. F.S. 117.209 and 117.265. A commissioner of deeds registered as an online notary has a different territorial rule; we are not flattening that into the ordinary notary case.
• Traditional Florida notarization is still a physical-presence act. A Florida notary who never registered as an Online Notary Public cannot finish the session from a webcam. The registration expires with the underlying notary commission. DOS RON page; F.S. 117.225.

Online notarization excludes solemnizing the rites of matrimony. F.S. 117.209. If the job is a wedding, this page is the wrong product.

Identity is not a courtesy checkbox. F.S. 117.265 and 117.295, and Rule 1N-7, require remote presentation of a government ID, credential analysis, and identity proofing (knowledge-based authentication or another method that meets the chapter) unless the online notary personally knows the principal. The Department of State may publish lists of online notaries and self-certified RON service providers. Until a stricter rule lands, the statute’s floor for knowledge-based authentication is five or more questions, 80 percent correct, and one additional attempt after a failed try. If those steps cannot be satisfied, the online notary may not perform the act. That is when mobile and walk-in stop being old-fashioned and become the product that can finish.

The session file is part of the act. F.S. 117.245 requires a secure electronic journal and an uninterrupted audio-video recording, retained at least 10 years after the notarial act. That printed floor is twice the five-year record Texas SOS publishes for its online notaries. For an electronic will, a full copy of the recording must be maintained by a qualified custodian under chapters 731 and 732 — we cite that path; we do not pretend every consumer RON checkout is that custodian.

What actually needs a notary on a Florida LLC / KYC stack

Florida LLC formation is filed with the Department of State (Sunbiz) as Articles of Organization. The live instructions we retrieved say the authorized representative and the registered agent must sign. They do not say the Division requires a notary for that filing. People still show up asking for a notary because a bank, a processor, a landlord, or a mailbox asked for a jurat or acknowledgment on a different piece of paper that happens to sit next to the LLC.

We do not publish a bank-by-bank or county-by-county “accepts RON” matrix we have not read on that desk’s page this month. If you need the operating address to clear KYC, that is a different product — and not this site’s directory.

24/7 versus scheduled, in this state

Because in-state RON is live, 24/7 is a real option for many Florida packets — if the receiving desk will take a remote act. A Florida online notary or a notary commissioned in another RON state can both close that session. Vendor availability letters live on the directory, once.

If the desk wants a traditional Florida seal on paper, or identity proofing fails, you are shopping store hours or a mobile appointment. That is the C on walk-in / mobile showing up as a calendar, not a failure of the state rule.

F.S. 117.275 prints a statutory maximum for what an online notary (or that notary’s employer) may charge for the online notarial act: not to exceed $25. Fees for other services, including the RON service provider, are not capped by that section. That is a state fee cap for a Florida-commissioned online notary, not a platform sticker and not a UPS price. Form 1583 as a Florida use-case — without becoming a mailbox review

USPS will not let a CMRA hand you mail until PS Form 1583 (June 2024) is complete. The applicant signs in the physical presence of the CMRA (or authorized employee) or of a notary public. The form’s note allows real-time audio-and-video. A Florida signer can use a Florida online notary or an out-of-state remote notary. That is the same interstate-recognition idea as Texas, and the contrast with California, where in-state notaries still cannot perform RON.

What we will not do here: grade iPostal1, pick a Miami storefront, or explain CMRA flags. Those are mailbox questions. The notary question is: did the session match the form (U.S.-commissioned notary, two IDs, home address matching the address ID), and will the CMRA accept that session? A sequence that usually wastes less money

1. Read the receiving desk’s current instruction. If they printed “in person,” “wet ink,” or named a wedding, do not buy a RON session to argue with them.
2. If they accept remote notarization, you may use a Florida online notary or a notary commissioned in another RON state. The Florida Department of State is the authority for the in-state registration; NASS and NNA are the country sources. The platform’s live notary pool is the operational fact.
3. Budget the extras from the official page — extra seal, extra signer, witness — before you upload a six-signature packet at the $25 sticker. The $25 in F.S. 117.275 is the notarial-act cap, not a promise that the platform’s checkout stops there.
4. If identity proofing fails the statutory retry, stop treating “try again at midnight” as a plan. F.S. 117.265: if credential analysis and identity proofing cannot be satisfied, the online notary may not perform the act. Switch to mobile or a walk-in. NotaryLive’s FAQ describes a Personal Verifier path; that is their product, not a universal escape hatch.
5. Keep the session confirmation. RON’s value in a later dispute is the recording Florida already requires online notaries to keep for at least 10 years. Walk-in’s value is the wet ink the desk already said it wanted.
